GOODMATE PETS TERMS OF SERVICE

These Terms of Service apply to your use of goodmatepets.com and purchases made from Goodmate Pets. Goodmate Pets is operated by Zak Michael Nosal, ABN 76 644 200 548 (Goodmate Pets, we, us or our).

By accessing the website or placing an order, you agree to these Terms, our Privacy Policy, Shipping Policy and Return and Refund Policy. If you do not agree, do not use the website or place an order.

1. AUSTRALIAN CONSUMER LAW

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded or limited.

2. ELIGIBILITY AND ACCOUNTS

You must provide accurate, current and complete information when using the website, creating an account or placing an order. You are responsible for maintaining the confidentiality of your account credentials and for activity performed through your account. Notify us promptly if you believe your account has been used without permission.

3. PRODUCT INFORMATION

We take reasonable care to describe and display products accurately. Colours and appearance may vary between screens, and product packaging or minor details may change. Images are illustrative and should be read together with the written product description, specifications and options.

We may correct genuine errors in product descriptions, images, availability or pricing. Nothing in this section permits misleading conduct or limits your rights where a product does not match its description.

4. PRICES, GST AND PAYMENT

Prices are displayed in Australian dollars unless stated otherwise. Goodmate Pets is not currently registered for GST. Prices and shipping charges shown at checkout are the amounts payable for the order, subject to correction of an obvious error before the order is accepted.

Payment must be authorised through an available checkout payment method. Payment information is processed by Shopify and relevant payment providers under their own terms and privacy practices.

5. ORDERS AND ACCEPTANCE

An order is an offer to purchase. An automated order confirmation acknowledges that we received the order but does not necessarily mean it has been accepted. We may decline or cancel an order where reasonably necessary, including because of unavailable stock, a genuine pricing error, suspected fraud, payment failure, delivery restrictions or an incorrect product listing.

If we cancel an order after payment, we will refund the affected amount to the original payment method. We may apply reasonable limits to quantities ordered for resale or misuse.

6. SHIPPING AND DELIVERY

Shipping costs, delivery information, split shipments, tracking, address responsibilities and delays are explained in our Shipping Policy. Delivery timeframes are estimates unless we expressly agree to a guaranteed date. Our obligations remain subject to the Australian Consumer Law.

7. RETURNS, REFUNDS AND CANCELLATIONS

Returns, remedies, refunds and order cancellations are governed by our Return and Refund Policy and the Australian Consumer Law. We are responsible for helping customers resolve problems with products purchased from us and will not require a customer to deal only with a manufacturer or fulfilment partner.

8. SAFE AND APPROPRIATE PRODUCT USE

Read and follow all product instructions, warnings, size guides and supervision recommendations. Pet products should be inspected regularly for wear or damage. Stop using a product if it becomes damaged or may create a hazard. No product is indestructible, and animals should be supervised where appropriate.

These instructions do not exclude liability that cannot lawfully be excluded and do not affect remedies for an unsafe or defective product.

9. ACCEPTABLE USE

You must not use the website unlawfully, interfere with its security or operation, attempt unauthorised access, introduce malicious code, scrape or exploit the website in a way that places an unreasonable load on it, impersonate another person, or use the website to infringe another person's rights.

10. INTELLECTUAL PROPERTY

Unless otherwise stated, the website's branding, written content, graphics, layout and other materials are owned by or licensed to Goodmate Pets and are protected by applicable intellectual property laws. You may use the website for personal shopping and information. You must not reproduce, distribute, modify or commercially exploit website content without permission, except where permitted by law.

11. THIRD-PARTY SERVICES AND LINKS

The website may use or link to third-party services, including Shopify, payment providers, delivery carriers and social platforms. Third parties may have their own terms and privacy policies. We are not responsible for third-party websites we do not control, but this does not remove any responsibility we have to you under applicable law for products or services we supply.

12. REVIEWS AND USER CONTENT

If you submit a review, image or other content, it must be honest, lawful and based on genuine experience. You must have the right to submit it. You grant us a non-exclusive, worldwide, royalty-free licence to display and use that content in connection with Goodmate Pets, subject to applicable privacy and consumer laws. We may moderate content that is unlawful, abusive, misleading, irrelevant or infringes another person's rights.

13. WEBSITE AVAILABILITY

We aim to keep the website accurate and available but do not guarantee uninterrupted or error-free access. We may maintain, update or change website features. We are not responsible for delay or failure caused by events beyond our reasonable control, subject to rights and obligations that cannot be excluded by law.

14. LIABILITY

To the maximum extent permitted by law, we are not liable for indirect or consequential loss that was not reasonably foreseeable. Where liability can lawfully be limited, it is limited to the extent permitted by law. Nothing in these Terms limits liability for fraud, wilful misconduct, personal injury caused by negligence, or any liability or consumer right that cannot be excluded or limited.

15. PRIVACY

Our collection, use and disclosure of personal information is described in our Privacy Policy. By using the website, you acknowledge that your information may be handled by service providers needed to operate the store, process payments, fulfil orders and deliver customer support, subject to applicable law.

16. CHANGES TO THESE TERMS

We may update these Terms from time to time. The version published when an order is placed applies to that order, unless a change is required by law or agreed with you. The current version and its last-updated date will be published on the website.

17. SEVERABILITY

If a provision of these Terms is found to be invalid or unenforceable, it will be read down to the extent necessary or removed, and the remaining provisions will continue to apply.

18. GOVERNING LAW

These Terms are governed by the laws of Victoria, Australia, and applicable Commonwealth laws. You and Goodmate Pets submit to the non-exclusive jurisdiction of the courts of Victoria and courts entitled to hear appeals from them. This does not prevent a consumer from exercising rights available under applicable consumer law.
